on Killing of Mr. Rohit Prajapati by the Police in an alleged fake encounter

Sub: For investigation and necessary action on a case of killing of Mr. Rohit Prajapati by the Police in an alleged fake encounter near Tamar of Ranchi district of Jharkhand.

Dear Sir,

With due respect, I would like to bring your kind attention on a case of killing of Mr. Rohit Prajapati by the Police in an alleged fake encounter near Tamar of Ranchi district of Jharkhand in the morning on February 7, 2012. Mr. Rohit Prajapati S/o Mr. Sukhdev Mahto was resident of Dumardih comes under Palkot Police station of Gumla district of Jharkhand.

Case details:

An auto driver Mr. Rohit Prajapati S/o Mr. Sukhdev Mahto resident of Dumardih comes under Palkot Police station of Gumla district of Jharkhand had gone to Jamshedpur with his friends two days back and going back to Gumla with his friends in the early morning on February 7, 2012.

The CRPF Jawans of 94 Battalion were returning from Hunthu of Tamar and saw a Bolero (OR-14T-5552) coming from Tamar and going towards Khunti. They indicated driver to stop the vehicle but the driver didn’t follow the Jawans’ instruction. Hence, the Jawans informed the CRPF 196 Battalion and Police about it and also followed the vehicle.

Finally, the CRPF Jawans and Police fired on the vehicle. Consequently, Rohit got bullet injuries in his chest, neck and head. The police could able to arrest Mr. Rohit but his two friends ran away. Rohit died in the spot due to heavy bleeding. The police claim that the vehicle was stolen from Rourkela and many criminals were in the vehicle and escaped during the encounter.

However, the parents of Mr. Rohit Prajapati – Mr. Sukhdeo Mahto and Mrs. Urmila Devi alleged that the police have killed their son Mr. Rohit in a cold blood murder and coining it as the result of an encounter. The most important question is since, the CRPF and police Jawans had rounded the vehicle from all corners and the vehicle got accident as claimed by the police, in this case how did two alleged criminals escape from the Police?

Since, it is a clear case of gross violation of the right to life and dignity of Mr. Rohit Prajapati by the police in an alleged encounter therefore, I request the National Human Rights Commission for the following actions.

A high level inquiry should be established on a case of killing of Mr. Rohit Prajapati by the Police in an alleged fake encounter.

A case should be registered under the section 302 of IPC against the CRPF and police Jawans who were involved in the alleged encounter.

The NHRC should also investigation whether its guideline on encounter was followed by the Police.

The family of the deceased person should be compensated of Rs. 10 lakh and given a government job as Mr. Rohit Prajapati was an earning member in the family.
